Terms of Use

1. General provisions

These Terms of Use (“Terms”) set out the rules for using the Mezu mobile application (“Mezu”, the “App”).

By using Mezu, you agree to these Terms. If you do not agree with them, please do not use the App.

Mezu is an application intended for personal tracking of activities, habits, observations, and other information entered by the user.

2. Person responsible for Mezu

Mezu is developed and maintained by Katarzyna Panasiuk, based in Poland, European Union.

3. Nature of the App

Mezu is a tool intended for personally recording, organizing, and analyzing information entered by the user.

The App may generate statistics, summaries, charts, and other information based on user data.

Information presented by Mezu is informational and supportive in nature.

Mezu does not provide:

medical advice,
medical or psychological diagnosis,
therapy,
professional financial advice,
professional legal advice,
or any other professional advisory service.

Users should not make decisions concerning health, treatment, finances, or other significant matters solely on the basis of information presented by the App.

4. User account

Mezu currently does not require users to create an account.

Data created while using the App is stored locally on the user’s device in accordance with the Privacy Policy.

5. User responsibility for entered data

Users decide for themselves what information they enter into Mezu.

Users are responsible for content they store in the App, including its legality and respect for the rights of other persons.

Users should not enter information whose storage or sharing would violate another person’s rights.

If a user uses Mezu to record information concerning other people, they should do so with respect for their privacy and applicable law.

6. Local nature of data

Mezu is designed as a local-first application.

User data is stored locally on the user’s device. Mezu does not guarantee that data will remain available in the event of device failure, operating-system issues, database corruption, App uninstallation, or other technical problems.

Users should regularly create backups of data they consider important.

7. Backups and data export

Mezu may allow users to export data for backup purposes.

Users are responsible for:

creating backups,
choosing where backups are stored,
protecting files from unauthorized access,
keeping backups in a way that allows them to be used later.

The Mezu developer does not automatically store backup copies of user data.

Loss of the device, deletion of the App, or another event resulting in loss of local data may lead to permanent loss if the user does not have a backup.

8. Data import and replacement of the current database

Importing data may replace data currently stored in the App.

Before importing, users should make sure they have a backup of any current data they wish to keep.

The Mezu developer does not guarantee that data replaced as a result of an import can be recovered.

Users use the import function at their own responsibility and should make sure that the imported file is the intended copy of their data.

9. App operation and possible errors

Mezu is developed and updated, but uninterrupted and error-free operation cannot be guaranteed.

In particular, the following may occur:

technical errors
incorrect operation of certain features
problems resulting from operating-system updates
device compatibility issues
errors or irregularities in the operation of the local database
problems with notifications or other operating-system-dependent features
temporary unavailability of certain features

The Mezu developer makes reasonable efforts to ensure that the App operates properly and is developed in a useful manner, but does not guarantee completely error-free or uninterrupted operation.

10. Statistics, calculations, and information presented by Mezu

Statistics, charts, summaries, and other results generated by Mezu are calculated based on data stored in the App.

Their accuracy may depend, among other things, on:

the accuracy of data entered by the user,
completeness of the history,
skipped entries,
activity settings,
changes made by the user,
the operation of the current version of the App.

Results presented by Mezu should not be treated as guaranteed, scientifically validated, or professional assessments concerning the user.

Information and results presented by Mezu are intended for informational purposes and should be interpreted in the context of the data from which they were generated. They do not constitute professional advice or a basis for diagnosing a health condition or making decisions that require professional assessment.

11. Changes, updates, and App features

Mezu may be developed and updated.

Mezu may in the future:

add new features
modify existing features
improve or change how features work
remove features
change the appearance and interface of the App
change the technical requirements of the App.

Changes may be necessary for technical, security, legal, or development reasons.

The Mezu developer does not guarantee that every feature available in one version of the App will remain available in every future version.

12. Device and operating-system compatibility

The proper operation of Mezu may depend on the device, operating system, available storage, system settings, and other technical factors.

Mezu is not responsible for problems resulting solely from incompatibility between the device or operating system and the App’s requirements.

Certain features may require specific system permissions.

13. Notifications

Mezu may use local system notifications.

Delivery of notifications may depend on device settings, system permissions, Focus modes, power-saving mechanisms, and other operating-system features.

The Mezu developer does not guarantee that every scheduled notification will be displayed in every circumstance.

Notifications are intended as a supportive feature and should not be treated as the sole source of information about important deadlines or obligations.

14. Availability of the App

The Mezu developer may temporarily restrict availability of the App or particular features, including in connection with:

maintenance
updates
technical issues
security
system requirements
development changes.

To the extent permitted by applicable law, the Mezu developer does not guarantee uninterrupted availability of the App.

15. Intellectual property

The Mezu name, logo, visual design, interface, software code, graphics, texts, and other elements of the App may be protected by applicable intellectual-property laws.

Unless otherwise indicated, rights to these elements belong to the Mezu developer or to parties that have granted the relevant rights for their use.

Users are granted the right to use the App for its intended purpose and in accordance with these Terms.

Without appropriate permission, users may not copy, distribute, modify, or use elements of Mezu in a way that infringes the rights of the developer or other rights holders.

16. User content

Users retain rights to content they create and enter into the App, to the extent provided by applicable law.

Mezu does not acquire ownership of content entered by users.

Because data is stored locally, users are responsible for storing, securing, exporting, and, where applicable, sharing their data with other persons or services.

17. Lawful use of the App

Users agree to use Mezu in accordance with:

these Terms
applicable law
the rules governing the operating system and app store from which the App was downloaded.

Users should not use the App for unlawful activities or in a manner that infringes the rights of others.

18. Limitation of liability

To the extent permitted by applicable law, Mezu is provided in the condition and with the functionality available at the relevant time.

The Mezu developer does not guarantee that:

the App will always be available
the App will be completely free of errors
all features will work correctly under all circumstances
user data will never be lost or corrupted
statistical results will be suitable for every purpose or use
the App will be compatible with every device or future version of an operating system.

To the extent permitted by applicable law, the Mezu developer is not liable for losses or damage resulting in particular from:

failure or technical problems with the user’s device,
operation or updates of the operating system,
loss or corruption of local data,
failure to create a backup,
incorrect data import or export,
uninstalling the App,
improper use of the App,
use of data or statistics presented by Mezu as a basis for decisions requiring professional assessment.

The above limitations do not apply to the extent that liability cannot lawfully be excluded or limited.

19. Ending use of the App

Users may stop using Mezu and uninstall the App at any time.

Before uninstalling the App, users should create a backup of any data they wish to keep.

Uninstalling the App may result in loss of locally stored data.

20. Changes to these Terms

These Terms may be updated in connection with the development of Mezu, changes to App features, or legal or technical changes.

The current version of the Terms will be available on the Mezu website.

The date of the latest update will be shown at the beginning of the document.

Continued use of the App after changes take effect may constitute acceptance of the updated Terms, to the extent permitted by applicable law.

21. Governing law and applicable regulations

These Terms are governed by the laws applicable in Poland, subject to any mandatory provisions protecting users that may apply.

Nothing in these Terms is intended to limit consumer rights or other rights that cannot be excluded or limited under applicable law.
